Welcome to TalkAll, a product of MOVATEC TECNOLOGIA LTDA - ME. By accessing and using our services, you agree to the terms and conditions described in this document.
1. Acceptance of Terms
By accessing or using TalkAll services, you declare that:
- You have read, understood, and agree to comply with these Terms of Use
- You have the legal capacity to enter into this contract
- You are authorized to act on behalf of the company you represent, if applicable
- You agree to our Privacy Policy
If you do not agree with any part of these terms, you should not use our services.
2. Description of Services
TalkAll is a WhatsApp customer service platform that offers:
- Unified inbox for conversation management
- Multiple agents on a single WhatsApp number
- Automated chatbots
- Service reports and analytics
Artificial Intelligence Features:
- Writing Assistant — Provided by TalkAll, included in all plans. Offers intelligent response suggestions to standardize communication.
- Audio Transcription — Requires the customer to provide their own OpenAI API key. Automatically converts audio messages to text.
- Service Evaluation — Requires the customer to provide their own OpenAI API key. Automatically analyzes and scores service quality.
The services and features available vary according to the contracted plan. Services are subject to availability and may be modified or discontinued at any time, with prior notice.
3. Registration and Account
3.1 Account Creation
To use TalkAll, you must create an account providing accurate, complete and up-to-date information, including name, email, phone and company data.
3.2 Account Security
You are responsible for maintaining the confidentiality of your access credentials and for all activities performed on your account. Notify us immediately of any unauthorized use.
3.3 Multiple Users
Sharing login credentials among multiple users is prohibited. Each user must have their own individual account.
4. Acceptable Use
When using TalkAll, you agree NOT to:
- Violate applicable laws or third-party rights
- Send spam, unsolicited messages or illegal content
- Use the services for harassment, fraud or illegal activities
- Attempt to access systems or data without authorization
- Reverse engineer or attempt to extract source code
- Use unauthorized bots or automated scripts
- Resell or sublicense services without authorization
- Violate WhatsApp Business API policies
5. Intellectual Property
All intellectual property rights related to TalkAll, including:
- TalkAll trademark and logos
- Software, source code and algorithms
- Design, interface and user experience
- Content, documentation and marketing materials
Are the exclusive property of MOVATEC TECNOLOGIA LTDA - ME. Using the services does not grant you any ownership rights over these elements.
6. Payments and Billing
6.1 Plans and Prices
Plan prices are available on our website and may be changed with 30 days prior notice.
6.2 Payment Method
We accept credit card, bank slip and Pix. You must maintain a valid payment method during the contract term.
6.3 Renewal
Plans are automatically renewed at the end of each period, unless previously cancelled. Billing is done up to 3 days before the renewal date.
6.4 Refunds
Payments made are non-refundable, except when required by law. In case of plan downgrade, credit may be applied to future invoices.
7. Artificial Intelligence
7.1 Writing Assistant
The Writing Assistant is provided directly by TalkAll and is included in all plans. This feature offers response suggestions to help standardize customer communication.
7.2 Features with Customer API Key
Audio Transcription and Service Evaluation features use OpenAI artificial intelligence technologies and require the customer to provide their own API Key. When using these features:
- The customer is responsible for obtaining and maintaining their own OpenAI API Key
- OpenAI API usage costs are the exclusive responsibility of the customer
- Data may be processed by OpenAI servers located outside Brazil
- The customer must agree to OpenAI's terms of use to use these features
7.3 Limitations and Responsibilities
When using any AI feature, you acknowledge that:
- Results generated by AI are suggestions and may contain inaccuracies
- TalkAll does not guarantee the accuracy or reliability of AI results
- The final use of AI suggestions is your responsibility
- TalkAll is not responsible for unavailability or changes in third-party services (OpenAI)
8. Limitation of Liability
To the maximum extent permitted by law:
- TalkAll shall not be liable for indirect, incidental, special or consequential damages
- Our total liability, in any case, is limited to the amount actually paid for the service in the month the event giving rise to the claim occurred
- We are not responsible for interruptions caused by third parties or force majeure
- We do not guarantee that services will be uninterrupted or error-free
9. Cancellation and Termination
9.1 Cancellation by Customer
You can cancel your account at any time by contacting our support.
9.2 Suspension by TalkAll
We may suspend or terminate your account immediately in case of violation of these terms, non-payment or legal determination.
9.3 Effects of Cancellation
After cancellation, your access to the platform will be terminated and your data may be deleted after 30 days, except when retention is required by law.
10. Third-Party Services
TalkAll integrates with third-party services, including WhatsApp Business API and AI providers. When using these integrations:
- You agree to the terms of use of these services
- TalkAll is not responsible for the operation or availability of these services
- Changes in third-party services may affect platform features
11. Changes to Terms
We may update these Terms of Use periodically. Significant changes will be communicated by email or notice on the platform at least 30 days in advance. Continued use of services after changes constitutes acceptance of the new terms.
12. Applicable Law and Jurisdiction
These Terms of Use are governed by the laws of the Federative Republic of Brazil. Any dispute shall be submitted to the Court of Londrina, State of Paraná, to the exclusion of any other, however privileged.
