At TalkAll, we take very seriously the privacy of our customers ("Customers" and "Client") and our customers' users, or prospective customers ("Users"). This privacy policy applies to both our web sites and our service. This privacy policy governs our data collection, processing, use and sharing practices. It also describes your choices regarding use, access to and correction of your personal information. If you do not agree with the data practices described in this privacy policy, you should not use the sites or service. TalkAll reserves the right, at its discretion, to change this privacy policy from time to time to reflect changes in TalkAll's business, sites or services, or applicable laws. For this purpose, we will provide customers and users with thirty (30) days notice of any changes on the "Privacy Policy" page of the TalkAll website. We may also notify customers of the change using a contact information, email or other means of contact, if provided by customers and users. We are not responsible if customers choose not to disclose this information to users. The revised privacy policy will be effective as of the date of publication. Although we will notify you of any changes to this privacy policy, we recommend that you review this policy periodically. 1. Use of talkall services

The TalkAll Service

TalkAll provides omnichannel customer service solutions powered by Artificial Intelligence ("the Service"). TalkAll is the controller of your personal data and responsible for the collection, processing and disclosure of your personal data as described in this Privacy Statement. TalkAll's services will be available to customers and/or users residing in Brazil. Therefore, TalkAll respects and is constantly striving to be in compliance with the General Data Protection Law 2018/13.709 ("LGPD") to protect, guarantee and preserve the rights to such customers and/or users, to be applied or served eventually.

TalkAll Usage

We use our own service to answer questions on our sites to let potential customers know more about TalkAll's products. The information we collect and manage using the service for our own marketing belongs to us and is used, disclosed and protected in accordance with this Privacy Policy.

Use by our customers

Our customers use the service to provide customer service. TalkAll does not control the content of this knowledge or the types of information our customers choose to collect or manage using the service. This information belongs to them and is used, disclosed and protected by them in accordance with their privacy policies and is not subject to this privacy policy. TalkAll processes customer information as directed and in accordance with our customer agreements and stores it on our service providers' servers, but we have no control over its collection or management. TalkAll is not responsible for the practices employed by sites integrated by clients or from its services, nor the information or content contained therein. Please remember that when users and/or customers use a link to go from the services to another site, our privacy policy is no longer in effect. User and/or customer browsing and interaction on any other site, including those that have a link on our site, are subject to that site's own rules and policies. We strongly encourage and support customers and/or users to inform themselves about these rules and policies. Customer and/or users should familiarize themselves with the privacy practices of any site and/or user visits to understand what information is collected by the site, how the information is used, what choices the customer and/or user has, how to access the information, and how it is safeguarded. Our agreements with our customers prohibit us from using this information except as necessary to provide and improve the service as permitted by this privacy policy and as required by law. We have no direct relationship with individuals who provide personal information to our customers. TalkAll recognizes that you have the right to access your personal information. Our customers control and are responsible for correcting, deleting or updating the information they have collected while using the service. If there is a request to remove data, we will respond within a reasonable timeframe. We may work with our customers to help them notify their visitors about their data collection, processing and use. Our agreements with our customers prohibit them from using the service to collect, manage, or process sensitive information. We are not responsible for the use of information that customers collect on the service. We may transfer personal information to companies that help us provide our service. Transfers to subsequent third parties are covered by the service contracts with our customers.

Sensitive Information

These refer to credit or debit card numbers, personal financial information, insurance numbers, passport numbers, driver's license numbers or similar personal identifiers, racial or ethnic origin, physical or mental health conditions or information, or other employment, financial or health information.

2. Information we collect when you visit our sites

You are free to explore the sites without providing any personal information about yourself. If you express interest in obtaining additional information about our services, use our Contact Us or similar resources, register to use our sites, sign up for an event or webinar, or download certain content, we generally require that you provide us with your contact information, such as your name, title, company name, address, phone number, email address, or user name and password. This information is used to contact visitors about their interest in the company's goods or services and to interact with the company. If you use and interact with our sites from your computer or mobile device or interact with emails that we send, we automatically collect log files and other information about your device and your use of our sites through cookies, web beacons or similar technologies, such as IP addresses or other identifiers, which may qualify as personal data. Collection of personal information

This refers to any information that you voluntarily submit to us that personally identifies you, including contact information such as your name, email address, company name, address, phone number and other information about you or your business. Personal information may also include information about free and paid transactions you make on sites and information about you that is available on the Internet such as Facebook, LinkedIn, Twitter, and Google, or publicly available information that we acquire from service providers. Personal information also includes navigational information or payment information, where such information may directly or indirectly identify an individual. Navigational information refers to information about your computer and your visits to this site, such as your IP address, geographic location, browser type, referral source, length of visit, and pages viewed. Please see the Browsing Information section below. We collect and process payment information when you sign up for service, including credit card numbers and billing information, using third party providers. Other than that, we do not collect sensitive information about you.

Information we collect from customers

As a result of TalkAll's request for service and the terms and conditions of service, which are posted at https://www.talkall.com.br/politicas/termos-e-condicoes, TalkAll will collect the following information from customers:

  • Names, Email Addresses, and Addresses: TalkAll will collect all customer names, email addresses, and addresses to perform the service.
  • Billing Information: TalkAll will collect and process all billing information, including tax identification, tax identifiers, financial information, bank account, credit card number, and other related data used to bill for the service.
  • Time Zones: TalkAll collects and processes the default time zone related to a specific client for reporting purposes.

TalkAll collects personal information from its customers when the customer contracts TalkAll's services to create an account ("customer account"). As a result of contracting the service, TalkAll assumes that all personal information of the client, collected and processed, is provided with the client's express consent. In no event will TalkAll collect personal information that has not been consented to and is not voluntarily given by the customer.

TalkAll Blog & Community

Our service provides publicly accessible community services, including blogs and forums. Customers and/or users should be aware that any information that customers and/or users provide in these areas can be read, collected and used by others. Customer and/or user posts may remain even after customers and/or users cancel customer and/or user account.

Information about children

The Sites are not intended for children under the age of 16 and we do not knowingly or intentionally collect information from children under the age of 16. If you believe that we have collected information about a child under the age of 16, please contact us at comercial@talkall.com.br so that we may delete such information.

3. What device and usage data we process

Cookies

TalkAll uses cookies or similar technologies (such as web beacons) to analyze trends, administer the site, track users' movements around the site, and gather demographic information about our user base as a whole. To learn more about how we use cookies on our sites and how to manage your cookie preferences, see our Cookie Policy. When you visit our sites, our servers, or an authorized third party server, may place a cookie in your browser that may collect information, including personal data, about your online activities over time and across different sites. Cookies allow us to track overall usage, determine your preferred areas, facilitate your use by recognizing you, and provide you with a personalized experience. We also use web beacons on our sites. For example, we may place web beacons in marketing e-mails that notify us when you click on a link in the e-mail that directs you to one of our sites. Single Sign-On

You can login to the TalkAll platform using a single sign-on service (SSO), such as your Google or Facebook account. This service will authenticate your identity and provide you with the option to share certain personal information with us, such as your name and email address, to complete our registration form. These services may give you the option to post information about your activities on this site on your profile page to share with others in your network. Your interactions with social media features are governed by the privacy policies of the companies that provide the relevant social media features.

Social Media Resources

Our websites may use social media features, such as the Facebook "like" button, the "tweet" button, and other sharing widgets ("Social Media Features"). You may have the option, through these social media features, to post information about your activities on a website to a profile page of yours provided by a third party social media network to share with others in your network. The social media resources are either hosted by the respective social media network or hosted directly on our site. To the extent that social media resources are hosted by the respective social media network, the latter may receive information that you have visited our website based on your IP address. If you are logged into your social media account, it is possible that the respective social media network may link your visit to our sites with your social media profile.

Telephony registration information

If you use certain service features, we may also collect telephone log information (such as telephone numbers, time and date of calls, call duration, and types of calls) and location information (via IP address).

Navigation Information

When you use our services and view content provided by us, we automatically collect information about your hardware and software. This information may include your IP address, browser type, domain names, Internet Service Provider (ISP), files viewed on our site (e.g. HTML pages, graphics, etc.), operating system, click stream data, access times, and referring website addresses. This information is used by Talkall for the operation of the service, to maintain quality of service, and to provide general statistics regarding use of the TalkAll website. For this purpose, we link this automatically collected data to personal information such as: name, email address, address, and phone number.

4. How we use the information we collect

We use the information we collect only in accordance with this Privacy Policy. Customers who subscribe to our services are required by our contracts with them to comply with this Privacy Policy. We never sell personal information We will never sell your personal information to third parties.

Use of personal information

In addition to the uses identified elsewhere in this Privacy Policy, we may use your personal information to:

  • Provide service (which may include the detection, prevention, and resolution of technical and security problems);
  • Respond to customer support requests;
  • Fulfill obligations under the TalkAll customer service terms, reporting and statistical purposes;
  • Payment Management: If you have provided financial information, we will process your respective personal data to verify financial qualifications and collect payments to the extent that this is necessary to complete transactions with you in accordance with the contract;
  • Management Notices;
  • Database management and maintenance;
  • Product and/or service improvement/changes;
  • Interaction with third-party social networks;
  • Managing event registrations and attendance: we will process your personal data to plan and host the event or webinar, including related communication to you, based on the performance of our contract with you;
  • Developing and improving our sites: we will process your personal data to analyze trends, track the use of our sites and email interactions, to the extent that this is necessary for our legitimate interests to develop and improve our sites and provide our users with more relevant and interesting content;
  • Displaying personalized ads and content: we will process your personal data to conduct marketing research, advertise for you, give you personalized information about us and outside our sites, and other personalized content based on your activities and interests, to the extent it is necessary for our legitimate interests to advertise our sites or when necessary, to the extent you have provided your separate prior consent;
  • Sending marketing communications: we will process your personal data to send you marketing information, product recommendations and other non-transactional communications (e.g. marketing newsletters or push notifications) about us and our partners and affiliates, including information about our products, promotions or events as necessary for our legitimate interests to conduct direct marketing or to the extent you have provided your separate prior consent;

  • Send non-transactional information via WhatsApp, (e.g. business contact, company news, newsletters and promotional campaign), to the extent that you have provided your prior consent on our website, whatsapp or email;
  • Complying with legal obligations: we will process your personal data when cooperating with public and government authorities, courts or regulators in accordance with our legal obligations under applicable law, to the extent that it requires processing or disclosure of personal data to protect our rights and for our legitimate interests of protecting against misuse or abuse of our websites, to protect personal property or safety, to pursue remedies available to us and limit our damages, to comply with a judicial proceeding, court order or legal process, and/or to respond to legal requests.

Retention of personal information

TalkAll has no interest in retaining personal information or personally identifiable information about users and customers for any purpose other than the effectiveness of its service, statistical targeting purposes, and advertising. TalkAll may retain personal information to comply with legal obligations and for TalkAll's business purposes (e.g., to provide you with our services, to allow your participation in an event, and to comply with applicable legal, tax, or accounting requirements). TalkAll may retain personal information for longer periods than required by law if it is in TalkAll's legitimate business interests and is not prohibited by law. If TalkAll needs to close a customer account, it may take steps to mask personal and other information, but we reserve TalkAll's ability to retain and access data for as long as necessary to comply with applicable laws. We will continue to use and disclose this personal information in accordance with this privacy policy.

5. How we share and transfer the information we collect

Only for the purposes stated in this privacy policy and to perform the service, personal information may be disclosed by TalkAll, as necessary, to authorities, other companies within the same TalkAll affiliates, partners and other third parties, such as third party service providers used in connection with the TalkAll service and services related to them. The applicable standard data protection clauses in the respective contracts may be available for review to users upon appropriate request.

Service Providers

We employ other companies and individuals to provide services to visitors to our sites, our customers and service users and may need to share your information with them to make information, products or services available to you. Examples might include, providing marketing assistance, processing credit card payments. In all cases where we share your information with these agents, we suggest that the agent follow and comply with our policies on customer privacy and data handling. If you use your own third party code, applications, services or technology in connection with your use of the services, TalkAll will not support or be responsible for such code, applications, services or technology. If customer chooses to install, access or enable a third party offering, customer agrees that TalkAll may share and receive from the third party provider certain messages and other data as necessary for the interoperability or integration of such third party offering and that the third party provider's use of such data is governed by customer's separate agreement with such third party provider. Third Party Offerings are not maintained, monitored, tested, controlled, endorsed or reviewed by Humans, are governed by their own terms and conditions and are not included in the definition of services under this Agreement. Third party offerings may be terminated at any time, with or without cause.

Mandatory Disclosure

We reserve the right to use or disclose your personal information if required to do so by law or if we reasonably believe that the use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, order, or legal process.

Protection of customer and user personal information

TalkAll maintains technical, physical, and administrative security measures designed to provide reasonable protection for customer and user personal information against loss, misuse, unauthorized access, disclosure, and alteration. For example, we constantly and regularly backup customer and/or user data to help prevent data loss and aid in data recovery. Security measures include firewalls, end-to-end data encryption, and information access authorization controls.

TalkAll also protects against common web attack vectors by hosting in audited SAS 70 datacenters and implements firewalls and access restrictions on our servers to secure our network and better protect customer and/or user information. However, given that today's online environment is not completely secure, TalkAll does not guarantee that the security measures taken will prevent third parties from illegally and maliciously gaining access to customer and user personal information and the absolute security of such information during its transmission or storage in TalkAll's systems. While TalkAll is dedicated to protecting its systems and services, customers are responsible for protecting and maintaining the privacy of their passwords and accounts, protecting registration information, and must verify that the personal information TalkAll maintains about customers is accurate and up-to-date. TalkAll will promptly notify individuals whose personal information has been compromised in accordance with the notification procedures set forth in this Privacy Policy, or as required by applicable law. Access to personal data is restricted to TalkAll employees, contractors, and agents who need the data disclosed to perform their duties and develop or improve service.

6. How we share and transfer the information we collect

Only for the purposes stated in this privacy policy and to perform the service, personal information may be disclosed by TalkAll, as necessary, to authorities, other companies within the same affiliates of TalkAll, TalkAll's partners, and other third parties, such as third party service providers

7. How to access and control your personal data

You have the following data protection rights:

  • You may request access, correction, updating, or deletion of your personal information.
  • You can object to the processing of your personal information, you can ask us to restrict the processing of your personal information, or you can request the portability of your personal information.
  • If we collect and process your personal information with your consent, you may withdraw your consent at any time. Withdrawing your consent will not affect the legality of any processing done prior to your withdrawal, nor will it affect the processing of your personal information conducted on lawful grounds for processing other than consent.
  • If the user or customer considers that his/her rights under data protection laws have been violated, the user or customer may file a complaint with the supervisory authority of the user's or customer's residence. For example, for Brazil, it should be made to the National Authority for Personal Data Protection (ANPD).

8. Customer and user privacy choices

Users have (and customers may have) choices for the privacy and communications practices described in this privacy policy. Many of the choices customers and users may also be explained on customer websites and made at the time customers and users use a service or website. Customers and users may receive instructions and prompts in the experiences while navigating the services.

Choices Related to TalkAll Personal Information. Customers and users may refuse to provide personal information or personally identifiable information when requested by TalkAll's customers or by TalkAll, but certain services or all services may be unavailable to customers and users.

Cookie-related options. Users may have choices available to them to manage their cookie preferences. For example, a user's browser or Internet device may allow users to delete, disable, or block certain cookies and other tracking technologies. Users may choose to enable these options, but doing so may prevent users from using many of the key features and functions of the service and providing a better experience. Users may have an option regarding the use of cookies and other tracking technologies when using the service or visiting a client site.

Options Related to Customer Registration and Account Information. Customers have an account and can generally review and edit personal information or personally identifiable information by accessing and updating it directly or by contacting us. Customers may contact us if they have questions about their account information or other personal information.

Communication-related options. TalkAll notices, alerts and updates:

Marketing: TalkAll may send customers marketing content about TalkAll's websites, services and products through various communication channels, for example, email. Customers may opt-out of receiving such marketing communications by following the instructions in the communications they receive.

Newsletters and Other: TalkAll will send communications to customers that are required or necessary for users about TalkAll's service, notifications containing important information, and other communications requested by customers and users. Customers may not opt-out of receiving these communications. However, customers may adjust the media and format in which they receive these notices.

9. Changes to this privacy policy

Changes to this privacy policy will be posted on this page. If we make a significant change to TalkAll's privacy practices, we will provide notice on the site and through other means of contact provided by you or your customer. Changes to this privacy policy are effective as of the time they are posted on this page.
